2. Pre-Project Cancellation

If you cancel a project before any work has commenced, you are entitled to a full refund of any advance payment within 14 business days. Cancellation must be communicated in writing via email to [email protected].

3. Mid-Project Cancellation

If a project is cancelled after work has begun:

  • Payment for completed and approved milestones is non-refundable.
  • Deposits for upcoming milestones will be refunded in full, minus any costs already incurred for materials or third-party services purchased on your behalf.
  • All completed work and deliverables up to the point of cancellation will be transferred to you.

4. Post-Project Disputes

If you believe the delivered work does not meet the specifications agreed upon in the project scope document, you must notify us within 14 days of delivery. We will review the dispute and, if the work is found to be non-conforming, we will either remediate the issues at no additional cost or provide a partial refund proportional to the scope of non-conformance.

5. Non-Refundable Items

The following are not eligible for refunds:

  • Third-party licenses, domains, or hosting fees purchased on your behalf.
  • Work completed and approved during the project, including design revisions accepted in writing.
  • Consulting or advisory services that have been delivered.

Terms of Service

These Terms of Service ("Terms") govern the use of services provided by customwebsolutionlab, located at C. Juan Pablo II 2, Jaén, Jaén, España, España. By engaging our services, you agree to be bound by these Terms.

1. Scope of Services

customwebsolutionlab provides web development, design, and related digital services as described in individual project proposals and statements of work. The specific scope, deliverables, timelines, and pricing for each project are defined in a separate written agreement between the parties.

2. Project Engagement Process

Projects are initiated through a discovery phase, followed by a formal proposal. No work commences until the proposal is accepted in writing and any required deposit is received. Changes to the project scope after acceptance may result in revised timelines and additional costs, which will be communicated and agreed upon before implementation.

3. Payment Terms

  • Invoices are payable within 14 days of the invoice date unless otherwise agreed in writing.
  • Late payments may incur a penalty of 2% per month on the outstanding balance, in accordance with Spanish commercial law.
  • All prices are quoted in Euros (€) and include applicable taxes unless stated otherwise.
  • Work may be suspended if payment is overdue by more than 30 days.

4. Intellectual Property

Upon full payment, all intellectual property rights for deliverables specifically created for you under the project agreement are transferred to you. customwebsolutionlab retains ownership of pre-existing tools, frameworks, libraries, and methodologies used in the development process. We reserve the right to display completed work in our portfolio unless a confidentiality agreement is in place.

5. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the course of the project. This obligation survives the termination of the project for a period of 24 months. Confidential information includes business strategies, technical specifications, pricing, and client lists.

6. Limitation of Liability

customwebsolutionlab's total liability under any project agreement shall not exceed the total fees paid for the specific project giving rise to the claim. We are not liable for indirect, consequential, or incidental damages, including loss of revenue, data, or business opportunities.

7. Warranty

We warrant that all deliverables will conform to the specifications outlined in the project agreement for a period of 90 days following final delivery. During this warranty period, we will remedy any defects in the work at no additional cost. This warranty does not cover issues arising from third-party services, modifications made by you or third parties, or force majeure events.

8. Termination

Either party may terminate the project agreement with 14 days written notice. Upon termination, you will receive all completed work and pay for all milestones completed up to the termination date. The confidentiality and intellectual property clauses survive termination.

9. Governing Law and Jurisdiction

These Terms are governed by Spanish law. Any disputes arising from or related to these Terms shall be submitted to the exclusive jurisdiction of the courts of Jaén, España. Both parties agree to attempt mediation before initiating formal legal proceedings.

10. Changes to Terms

customwebsolutionlab reserves the right to update these Terms at any time. Material changes will be communicated via email to active clients. Continued engagement of our services after notification of changes constitutes acceptance of the updated Terms.
